and lawsuits
Ripoff Report's high rankings in the Internet
search engines lead to frustration by some companies
who feel they are being victimized by complaints
that may or may not have any merit, and that
Magedson solicits
these complaints only for his own profit.
Ripoff Report allows consumers to post complaints
anonymously. Rebuttals by the accused companies
are only published at Magedson's discretion.
Ripoff Report also allows
individuals to post unconfirmed complaints and
accusations against other individuals.
Aggrieved individuals can submit their complaints
against other individuals, and, after being
screened for personal information and curse
words (which are redacted), those statements
are posted online with the expectation that
public exposure will apply pressure to the targeted
individual. The individual
being accused usually has his or her full identity
revealed while the poster remains anonymous.
Ed Magedson said his staff only verifies the
complainants' real names, which are kept confidential,
and verifies that they have an actual email
address. This practice
has led to accusations of willful negligence
by Magedson and Ripoffreport for ""falling short
of what a reasonable person would do to protect
another individual from foreseeable risks of
harm." It has
been argued that these loose verification practices
encourage false claims and slander.
Ripoff
Report does not allow complaints about its own
services. However, there are a number of
allegations against Ed Magedson and the Ripoff
Report which are easily found online. Several
sites have been erected which attack Ripoff
Report and Magedson. Also many allegations have
been posted on Internet message boards, including
allegations that ripoffreport.com's search engine
optimization tactics violate Google's terms
of service.
Corporate
Advocacy and Remediation Program
At
least one lawsuit alleges that Magedson manipulates
information found on the Ripoff Report, and
attempts to extort money from companies in exchange
for removing (or editing) complaints posted.
It
also alleges that Magedson posts libelous statements
about them if they do not comply.
Magedson states that these claims are all false
and are the result of reported people and businesses
trying to show that he wrote some of the questioned
content so that the Communications Decency Act's
"safe harbor" provision does not apply. Most
recently, in GW Equity v. Xcentric Ventures,
LLC, a Texas district court dismissed all claims
including one that the Advocacy Program was
extortionate."
The Phoenix New Times
explains that at least 30 companies now pay
Magedson to comment on unfavorable reports on
Ripoff Report. Ripoff Report offers the "Corporate
Advocacy and Remediation Program."
Businesses
pay Magedson a fee, plus a monthly retainer.
And in exchange, Magedson makes "EDitor's
comments" next to complaints — pointing out
that the company, as part of the program, has
agreed to give a full refund to aggrieved consumers,
that the number of complaints may not be out-of-line
with the size of the company and pointing out
any claims against the company he considers
false.
Magedson's
litigation attorney, Maria Crimi Speth, states
there is a sliding fee scale for interested
businesses, depending on the number of complaints
the businesses have on Ripoff Report and "many
other factors," and that the price can be as
low as a few hundred dollars per month. Court
files documents and several business owners
who spoke to the Phoenix
New Times, state that joining the "Corporate
Advocacy and Remediation Program" was offered
for some businesses for more than $50,000, on
top of a monthly retainer fee. Other businesses
have documented solicitations of up to $250,000
to join the program.
Critics
argue how can Magedson accept payment from the
same companies that he claims to be fighting,
especially when he was once so critical of the
Better Business Bureau for doing the same thing.
Magedson claims the big difference is that he
gets all the complaining consumers their money
back—which is a pre-condition to entering the
Program.
Lawsuits
Many
companies have sued Rip-off Report or Magedson.
At any given moment there are always lawsuits
pending against Ripoff Report. None of these
cases have ever gone to trial. Some have been
settled, and in other cases Ripoff Report

Today
11th September 2009 it came to our attention that somebody
under the fake name of "Jose Fullentas" has filed a
100% fake report about myself and our company:
Fact
is that we DO NOT KNOW who this Gentlemen "Jose Fullentas"
is and that we
a)
We never issued any invoice to him for "franchise fees"
or anything else for that matter. He does not even know
our bank account details.
b)
we never received any money from Mr. "Fullentas" and
c)
we have never dealt with such a person before and
d)
This person and his wrong accusations are 100% fake!
If
Mr. "Fullentas" or whatever his true identity is would
be for real, he should kindly provide evidence of the
wire transfer of $28,000 and a bank confirmation letter
from Mr. "Fullentas" bank, that the wire of $28,000
has been sent to 21st Equity Homes for "Franchise Fees".
Further
we would like to see a copy of the invoice sent by 21st
Equity, which he must have received from us for "franchise
fees"....?
Lastly,
where is his contact address, Tel no. etc. etc.?? Why
is he hiding behind a fake IP address with no real company
name? When we goggled his name today only this fake
report showed up and further Mr. "Fullentas" remains
a "GHOST".
As
Director of "Concrete Cement in Kuala Lumpur, Malaysia"
he and his "Fake Company" should be VISIBLE on Google,
don't you think? The answer is clear: This person does
not exist at and neither does his company. Google 21st
Equity Homes and you will for sure find us!
Moreover,
why did Mr. Jose Fullentas never sent us an e-mail to
"claim his franchise fee" back? Why did we never receive
any letters from his lawyers? Because he never paid
anything to us and it is a shame to see that the web
site ripoffreport.com is being abused by some FAKE IDENTITY
SCAM ARTISTS to pull legitimate companies down and harm
their reputation.
We
wrote today to the management and Editor of Ripoffreport.com
and requested to have this fake report being removed
with immediate effect. We further provided all evidence
and e-mail communications with Mr. "Fullentas"
who contacted us via e-mail for the first time on 9th

Fox television sought to expose the information highway
criminals that have been making attempts at extorting
good business owners money. 7 news Carmel Cafiero concludes
her news segment by saying: "In the mean time the Internet
provides a well of information... And a well of misinformation."
In
this day and age, the amazing technology that brought
the Internet into our every day life allows one to reach
anyone in the world from the click of the mouse; but
then all of a second it can all go wrong.
Any
law abiding, spiritual individual or any business could
also fall prey of the extortion ring that has been terrorizing
successful, integral business owners. When this happened
to Helene Goldnadel of International Creative Artists,
the licensed acting school, she put up a site to fight
two extortion sites and their owners.
"Let's
say one owns a very successful business, says Helene
Goldnadel." She continues: "Such hard working, dedicated
business owner has happy clients, he/she works in integrity,
and creates a win-win situation where the business does
well and the clients get exactly the services they expect."
"Then
one day that same business owner gets emails from two
hate sites that the reader can find out about by logging
onto a site which I created, which URL is listed below,"
says Goldnadel. The message in those emails was:
"A
complaint was placed against you". "When this happened
and I checked those "complaints"," says Helene Goldnadel,
"I almost fell off my chair! I read to my astonishment
that our institution was "a rip-off place", that "I
was on drugs", "a child molester", that "all of our
employees and myself were transvestites, that I, a petite
woman from France, used to be called Harold, which was
changed to Helene(!), and that I was "organizing gay
parades in my area", she adds.
Helene
Goldnadel quickly figured out that the author of the
postings was allegedly the owner of a modeling school
in her area, that got kicked out from one of the non-licensed
franchised schools and was now operating on her own
(without any proper licensing still) and probably not
doing as well as the International Creative Artists
Institution does.
"I
contacted the site owner, ED MAGEDSON which you can
only do by e-mail at first, and told him that these
"complaints" were made by the same person, under different
alias and faked e-mail addresses" says Goldnadel. She
also asked him to please check that the complainants
do not exist and that those postings are just a poor
attempt from the "wanna be competition" to attack her
Institution and herself.
The
response of ED MAGEDSON (Owner of Ripoffreport.com)
was that he could never remove anything from his site…
Unless Goldnadel and International
Creative Artists pay him $50,000 plus a monthly payment
of $5,000 for "monitoring" the postings!!

The
site created by Helene Goldnadel is out to identify
the defamation for potential readers, to protect her
reputation, her business and her graduates reputation
who posted responses to clear their school on that trashy
site. "Next thing they knew, THEY were being slandered",
says Goldnadel. Other business owners joined and linked
their sites to Goldnadel's. Helene Goldnadel continues:
"I
found out that the financial demands from the criminals
in question range from a few hundred dollars a month
to a few thousand dollars a month with "down payments"
of anywhere between five thousand to fifty thousand
dollars."
Helene
adds: "Now be aware that the owner of that site actually
owns a few sites! If you do a search on my name or company
name, two sites come up, that are owned by the same
people. (Both sites are exposed on Helene Goldnadel's
site listed below.) She continues: "If some one decides
to pay off the extortionists, you might consider the
possibility that a month or two down the line, the defamation
could move to another one of their sites, especially
if a person or company makes a big bulk one time payment
to the extortionists! And then what? Are you going to
pay yet more money? Until when?!"
The
FBI is conducting an investigation at this time; "it's
about time!" says Goldnadel who linked her site denouncing
the slandering sites to all the other victimized business
owners sites as they contact her every day. When you

on the owners of those hate sites, and identify the
IP addresses of the people responsible for the slander
and the defamation.
